స్వాతంత్య్రం వచ్చి ఆరు దశాబ్దాలు దాటిన తరువాత కూడా మన లౌకిక
ప్రజాస్వామిక వ్యవస్థ విషమ పరీక్షను ఎదుర్కొంటున్నది. మతం మారడం, వెనకకు
రావడం అనేది వ్యక్తి ఇష్టానికి పరిమితం కాకుండా సామాజిక, రాజకీయ వివాదంగా
మారిపోతున్నది. ధరమ్ జాగరణ్ సమితి అనే సంస్థ ఈ నెల ఎనిమిదవ తేదీన ఆగ్రాలో
ఘర్ వాపసీ కార్యక్రమం చేపట్టి రెండు వందల మంది ముస్లింలను హిందు మతంలోకి
మార్చిందని తెలుస్తున్నది. క్రిస్మస్ రోజున అలీగఢ్లో ఐదు వేల మందిని హిందు
మతంలోకి చేర్చుకుంటామని ఈ సంస్థ ప్రకటించింది. దీనిపై పార్లమెంటులో దుమారం
చెలరేగడంతో స్థానిక జిల్లా యంత్రాంగం ఈ కార్యక్రమాన్ని నిషేధించింది. తాము
ఈ కార్యక్రమాన్ని వాయిదా వేసుకున్నామని, పై నుంచి అనుమతి రాగానే
నిర్వహిస్తామని సమితి నాయకులు అంటున్నారు.
బీహార్లోని భాగల్పూరు సమీపాన గల బరోహియా గ్రామంలో ఐదుగురు (హిందువులు)
క్రైస్తవ మతం పుచ్చుకున్నారని, వారిని కొందరు సంఘపరివార్ కార్యకర్తలు మళ్ళా
హిందు మతంలోకి మార్చారని అంటున్నారు. తమ వ్యాధి తగ్గినందువల్ల క్రీస్తు
పట్ల విశ్వాసం వ్యక్తం చేశామని, మతం మారలేదని ఆ ఐదుగురు చెప్పారని, తాము
ఇంకా దర్యాప్తు జరుపుతున్నామని పోలీసులు
అంటున్నారు. కొందరు ఆరెస్సెస్ కార్యకర్తలు వీరిని మళ్ళా హిందు మతంలోకి
మార్చి అందుకు సంకేతంగా గంగానదిలో స్నానం చేయించి, ఆలయంలో పూజలు చేయించారని
స్థానికులు వెల్లడిస్తున్నారు. ఉత్తర ప్రదేశ్లోని బహ్రాయిచ్ జిల్లా
కమలాపురి గ్రామంలో డ్బ్బై మంది హిందువులు క్రైస్తవ మతంలోకి మారారనే వార్త
ఉద్రిక్తతలు పెంచడంతో రాష్ట్ర ప్రభుత్వం మెజిస్టేరియల్ దర్యాప్తునకు
ఆదేశించింది. స్థానికులు కొందరు మతం మారలేదని అంటుండగా, మిగతా వారు ఇండ్లకు
తాళాలు వేసి పరారయ్యారు. దీనిని బట్టి ఉద్రిక్తతలు ఎంతగా పెరిగిపోతున్నాయో
తెలుస్తున్నది.
ఇతర మతాలకు హిందుమతస్తులను చేర్చుకునే హక్కు ఉన్నట్టే హిందు మత పెద్దలకు
ఇతరమతస్తులను చేర్చుకునే హక్కు ఉంటుంది. ప్రభుత్వం ఏ మతం వైపు మొగ్గు
చూపకుండా అన్ని మతాలను సమానంగా గౌరవించాలె. ఏమతస్తులు
బలవంతానికి,ప్రలోభాలకు పాల్పడకుండా పెద్ద మనిషి పాత్రను పోషించాలె. అన్ని
మతాల పెద్దలు కూడా పరస్పరం చర్చించుకొని సామరస్యం సాధిస్తే ఉద్రిక్తతలకు
తావుండదు.
మత మార్పిడుల పేరుతో ఉద్రిక్తతలు పెరిగిపోతుండడం పట్ల కొద్ది రోజులుగా
పార్లమెంటులో కూడా ఆందోళన వ్యక్తమవుతున్నది. ఇటీవలే లోక్సభలో ఓ కేంద్ర
మంత్రి మాట్లాడుతూ- అన్ని రాష్ర్టాలు, కేంద్రం మత మార్పిడుల నిరోధక చట్టం
చేయాలని అభిప్రాయపడ్డారు. ఇప్పటికే ఐదు రాష్ర్టాలు ఇటువంటి చట్టాలు చేశాయి.
ఈ నేపథ్యంలో ఇటువంటి చట్టాలు సమస్యను పరిష్కరించగలుగుతాయా? అవి రాజ్యాంగ
స్ఫూర్తికి విరుద్ధం కాదా అనే ప్రశ్నలు తలెత్తుతున్నాయి. కొన్ని
రాష్ర్టాలలో మాదిరిగా- మత మార్పిడి చేసుకోవాలంటే మొదట ప్రభుత్వానికి
సమాచారం అందించి నిర్దేశిత కాలం తరువాత మారాలని ఆంక్షలు పెట్టడం
ప్రజాస్వామ్య వ్యవస్థలో ఆమోదనీయం కాదు. ఒక మనిషికి ఒక మతంపై లేదా దేవుడిపై
నమ్మకం ఏర్పడవచ్చు. అది అతడి వ్యక్తిగత విషయం. దీనిపై ప్రభుత్వ నియంత్రణ
ఉండడం భావ స్వేచ్ఛకు భంగకరం. రాజ్యాంగం కూడా మత స్వేచ్ఛను, మత ప్రచార
హక్కును గుర్తిస్తున్నది. బహుళత్వం భారతీయ సమాజ లక్షణం. వైదికంలోని భిన్న
శాఖలు, వైదికేతర బౌద్ధ జైన మతాలు భారతీయ సమాజాన్ని సుసంపన్నం చేశాయి.
ఇప్పటికీ వైదిక పరిధిలోకి రాకుండా గ్రామీణ దేవతలను పూజించేవారున్నారు.
ఒకప్పుడు రాజు ఒక మతాన్ని, రాణి మరో మతాన్ని అవలంబించిన సందర్భాలు ఉన్నాయి.
ఇటువంటి సహజీవన సంస్కృతిని కాపాడుకోవడం ఎట్లా అనేది మన రాజకీయ నాయకత్వం
ఆలోచించాలె.
బలవంతపు మత మార్పిడులను వ్యతిరేకించ వలసిందే. ప్రలోభాలతో మత మార్పిడి
చేయడం ఆయా మత సూత్రాలకే విరుద్ధం. అయితే వీటిని అరికట్టడం చట్టాలతో సాధ్యం
కాదు. ప్రజలను పేదరికం నుంచి బయట పడేయడం, విద్యావంతులను చేయడం ద్వారా ఈ
సమస్యను పరిష్కరించవచ్చు. మన దేశంలో హిందుమతం అధిక సంఖ్యాకుల విశ్వాసంగా
ఉన్నప్పటికీ, ప్రపంచం కుంచించుకుపోయిన నేపథ్యంలో ఒక రకమైన అల్పసంఖ్యాక
భావనకు, భద్రతా రాహిత్యానికి గురవుతున్నది. అందువల్ల ఈ మత ప్రముఖుల
ఆందోళనను అర్థం చేసుకోవచ్చు. అయితే కుల వ్యవస్థ, అస్పృశ్యత వంటి సామాజిక
జాడ్యాల వల్ల అట్టడుగు వర్గాల వారు స్వాభిమానం కాపాడుకోవడానికి, భద్రత కోసం
ఇతర మతాలలో చేరవచ్చు. తమ మతాన్ని సంస్కరించుకోవడం ద్వారానే ఈ బలహీనతలను
అధిగమించగలమని హిందు మత పెద్దలు గ్రహించాలె. యూరప్లో ప్రాటెస్టెంట్ ఉద్యమం
ఉధృతమైనప్పుడు క్యాథలిక్ మత పెద్దలు ప్రతి సంస్కరణోద్యమం నిర్వహించడం
గమనార్హం.
కేంద్రంలో అధికారంలో ఉన్న బీజేపీ ప్రభుత్వం పేదరిక నిర్మూలన జరిపితే
ప్రలోభాలతో మత మార్పిడులు జరుగుతాయనే ఆందోళనకు తావుండదు. ఇతర మతాలకు హిందు
మతస్తులను చేర్చుకునే హక్కు ఉన్నట్టే హిందు మత పెద్దలకు ఇతర మతస్తులను
చేర్చుకునే హక్కు ఉంటుంది. ప్రభుత్వం ఏ మతం వైపు మొగ్గు చూపకుండా అన్ని
మతాలను సమానంగా గౌరవించాలె. ఏ మతస్తులు బలవంతానికి, ప్రలోభాలకు పాల్పడకుండా
పెద్ద మనిషి పాత్రను పోషించాలె. అన్ని మతాల పెద్దలు కూడా పరస్పరం
చర్చించుకొని సామరస్యం సాధిస్తే ఉద్రిక్తతలకు తావుండదు. మన లౌకిక,
ప్రజాస్వామ్య వ్యవస్థను కాపాడుకోవలసిన బాధ్యత మన అన్ని పక్షాలపై ఉంది.

ఆరోగ్య హక్కు
కేంద్ర ప్రభుత్వం బుధవారం విడుదల చేసిన జాతీయ ఆరోగ్య విధానం- 2015
ముసాయిదా ఆరోగ్యాన్ని ప్రాథమిక హక్కుగా గుర్తించాలని సూచించడం హర్షణీయం.
సూచనలను స్వీకరించడానికి ఈ ముసాయిదాను ప్రజల ముందు పెట్టడం వల్ల చర్చకు
ఆస్కారం ఏర్పడింది. రాజ్యాంగం పౌరుడి జీవించే హక్కును గుర్తిస్తున్నది.
ఆరోగ్య పరిరక్షణ ఇందులో భాగమే. అంతర్జాతీయ ఒడంబడికలు, న్యాయస్థానాల
తీర్పులు, వివిధ దేశాలలో పోకడలు అన్నీ ఆరోగ్య హక్కును గుర్తించక తప్పని
పరిస్థితిని కల్పిస్తున్నాయి. సహస్రాబ్ది అభివృద్ధి లక్ష్యాలను అందుకోవాలని
భావిస్తున్న నేపథ్యంలో ఆరోగ్య రక్షణకు, వైద్య వసతుల కల్పనకు చర్యలు
తీసుకోవలసిందే. సూత్రప్రాయంగా ఆరోగ్య విధాన ముసాయిదా ప్రజల ఆరోగ్య
పరిరక్షణకు పూచీ ఇస్తున్నప్పటికీ ఈ సదాశయం ఆచరణలో ఎంత వరకు
ప్రతిఫలిస్తుందనే సందేహం కలుగుతున్నది.
ఆరోగ్యాన్ని హక్కుగా గుర్తిస్తే ప్రభుత్వం దీనిని అందించలేక పోవడం నేరంగా
మారుతుంది. దీనిపై న్యాయస్థానాన్ని ఆశ్రయించే అవకాశం కూడా ఉంటుంది. ఆరోగ్య
విధాన ముసాయిదాలో ఉన్న మరో ప్రధాన అంశం- అనారోగ్యం కలగకుండా ముందు జాగ్రత్త
చర్యలు తీసుకోవడం. పరిశుభ్రత, పోషకాహారం, పొగాకు మద్య సేవనాన్ని
అరికట్టడం, కాలుష్య నియంత్రణ, మహిళలపై హింసను నిరోధించడం మొదలైన ఏడు
అంశాలతో కూడిన స్వాస్థ్య నాగరిక అభియాన్ సామాజిక ఉద్యమాన్ని చేపట్టాలని
ముసాయిదా సూచిస్తున్నది.
విద్యా సెస్ మాదిరిగా ఆరోగ్య నిధులను సేకరించాలని కూడా ప్రభుత్వం
భావిస్తున్నది. ప్రభుత్వ ఆస్పత్రుల ద్వారా ఉచిత వైద్య పరీక్షలు, మందులు,
సూచనలు ఇవ్వాలని ముసాయిదా నిర్దేశిస్తున్నది. అయితే ప్రైవేటు రంగ విపరీత
పోకడలను అరికట్టడంపై ఆరోగ్య విధాన ముసాయిదాలో స్పష్టత లేదు. పైగా ఈ
నియంత్రణ లైసెన్స్ రాజ్కు దారి తీస్తుందనే ఆందోళనను ప్రస్తావించింది.
అట్టడుగు వర్గాలకు ఉచిత వైద్యం అందించడం ప్రభుత్వ బాధ్యత. అయితే స్థోమత
ఉన్న వారు ప్రైవేటు వైద్యాన్ని ఆశ్రయిస్తే వారు మోసపోకుండా చూడవలసిన బాధ్యత
కూడా ప్రభుత్వంపై ఉంటుంది.
ఆరోగ్య బీమాను విస్తరింప చేయడంతో తమ బాధ్యత తీరుతుందని ప్రభుత్వం
భావించకూడదు. వైద్య విద్యను గగన కుసుమంగా మార్చడం ఈ సమస్యలకు ఒక కారణం.
వైద్య విజ్ఞానాన్ని మరింత విస్తృతం చేస్తే, వైద్యం వ్యాపారంగా కాకుండా
సేవారంగంగా మిగులుతుంది. ఆయుర్వేద, హోమియోపతి వంటి వైద్య విధానాలపై కేంద్ర
ప్రత్యేక శ్రద్ధ చూపుతున్నదని ముసాయిదాను బట్టి తెలుస్తున్నది. వైద్య
రంగంలో ఆధునిక విజ్ఞానాభివృద్ధిని ఆయుర్వేదానికి కొనసాగింపుగా అర్థం
చేసుకొని రెండింటినీ మిళితం చేయాల్సింది. కానీ ఆయుర్వేదాన్ని ముతక విధానంగా
ఆలోపతిని ఆధునికతకు చిహ్నంగా మార్చారు.
విజ్ఞానాన్ని ఈ విధంగా విడదీయడమే పొరపాటు. వైద్య పరిజ్ఞానాన్ని
సమగ్రమైందిగా తీర్చిదిద్దకుండా పరస్పర అవగాహన లేని వైద్యులను తయారు చేయడం
మంచి పద్ధతి కాదు. ముసాయిదాలో సమగ్రత దిశగా అడుగు వేయాలనే ఆలోచన
వ్యక్తమైనప్పటికీ స్పష్టత లేదు.
ఆరోగ్య విధాన ముసాయిదాను అర్థం చేసుకునే ముందు క్షేత్ర స్థాయి పరిస్థితిని
కూడా పరిగణనలోకి తీసుకోవడం అవసరం. ప్రపంచీకరణ, ప్రైవేటీకరణ విధానాలు
అమలయిన తరువాత- గ్రామీణ ప్రాంతంలో ప్రజారోగ్య వ్యవస్థ బలహీనపడ్డది.
ఆరోగ్యశ్రీ వంటి పథకాలు పైకి గొప్పగా పనిచేసినా ఆ నిధులు ప్రైవేటు
ఆస్పత్రులను బలోపేతం చేయడానికి ఉపయోగపడ్డాయి. ఇప్పుడు జిల్లా స్థాయిలో కూడా
తగినంత వైద్య సదుపాయాలు ప్రభుత్వ రంగంలో లేవు. దీనికి తోడు ప్రైవేటు
రంగంపై నియంత్రణ లేక పోవడం పెద్ద సమస్యగా మారింది. ఆస్పత్రులు, వైద్యులు,
మందుల కంపెనీలు కుమ్మక్కు కావడం, నగర ఆస్పత్రులు గ్రామీణ వైద్యులు అవగాహనకు
రావడం మొదలైన వికృత పోకడల వల్ల పేదలు మందులపై అవసరం లేని శస్త్ర
చికిత్సలపై వ్యయం చేయవలసి వస్తున్నది.
సహజంగా జరిగే ప్రసవానికి బదులు శస్త్ర చికిత్స చేయడం, అనేక మంది మహిళలకు
అవసరం లేకున్నా గర్భసంచి తీసివేయడం వంటి ఈ వికృత పోకడల దుష్ఫలితాలే. ఈ
పరిస్థితిని చక్కదిద్దాలంటే తగిన నియంత్రణా వ్యవస్థ ఉండాలె. స్వీయ నియంత్రణ
వల్ల మార్పు సాధ్యమనే వాదన ఉన్నప్పటికీ, ఆ దిశగా కొన్ని ప్రయత్నాలు
సాగుతున్నప్పటికీ, ఇప్పటి పరిస్థితుల్లో ప్రభుత్వం పటిష్టమైన నియంత్రణ
విధానాన్ని అవలంబించడం అవసరం. ప్రభుత్వం సదుద్దేశంతో, సమర్థవంతంగా
వ్యవహరించినప్పుడు నియంత్రణ చక్కగా సాగుతుంది, లైసెన్స్రాజ్ మళ్ళా వ
చ్చిందనే ఆరోపణలకు తావుండదు. ప్రజారోగ్య వ్యవస్థను పటిష్టపరచడం, మంచినీటి
వసతి కల్పించడం, పారిశుధ్య చర్యలు చేపట్టడం వంటి కనీస బాధ్యతను ప్రభుత్వాలు
నిర్వర్తిస్తే చాలా వరకు ఆరోగ్య హక్కును పరిరక్షించినట్టవుతుంది.
కలెక్టర్ పదవిని ఎప్పుడు ప్రవేశపెట్టారు ?
స్థానిక స్వపరిపాలనా సంస్థలు
స్థానిక పలనా వ్యవహారాలను సమర్థవంతంగా నిర్వహించేందుకు తోడ్పడే సంస్థలను
స్థానిక ప్రభుత్వాలు అంటారు. గ్రామ స్వరాజ్యమే రామరాజ్యం అనే గాంధీ కలలను
సాకారం చేయడానికి భారత రాజ్యాంగంలోని ప్రకరణ 40 పంచాయతీరాజ్ సంస్థలను
ఏర్పాటు చేయాలని పేర్కొంది. అయితే IVవ భాగంలో పేర్కొన్న వీటికి రాజ్యాంగ
బద్ధత లేకపోవడంతో ఆచరణలో సత్ఫలితాలు పొందలేదు. దీంతో కేంద్ర ప్రభుత్వం
ఎల్ఎం సింఘ్వీ కమిటీ సూచనల మేరకు పంచాయతీరాజ్, నగర పాలక సంస్థలకు 73, 74
రాజ్యాంగ సవరణల(1992) ద్వారా రాజ్యాంగ ప్రతిపత్తి కల్పించారు.
చారిత్రక నేపథ్యం
- రుగ్వేదంలో సభ, సమితి అనే రెండు స్థానిక స్వపరిపాలనా సంస్థల ప్రస్తావన
ఉంది.
-కౌటిల్యుడు తన అర్థశాస్త్రంలో గ్రామిక, గ్రామకూట అనే గ్రామాధికారుల
గురించి ప్రస్తావించారు. గ్రామాధికారిని గ్రామణి అని, 10 గ్రామాల అధిపతిని
దశగ్రామణి అని పిలిచే వారు.
- మెగస్తనీస్ కూడా తన ఇండికా గ్రంథంలో పాటలీపుత్ర నగరంలో మున్సిపల్
ప్రభుత్వాల గురించి వివరించాడు.
- మధ్యయుగంలో దక్షిణ భారతదేశంలో చోళుల స్థానిక స్వపరిపాలన
ప్రసిద్ధిగాంచింది. మొదటి పరాంతకుని ఉత్తర మెరూర్ శాసనం ప్రకారం చోళులు తాటి ఆకులను బ్యాలెట్ పత్రాలుగా, కుండలను బ్యాలట్
బాక్సులుగా ఉపయోగించి స్థానిక సంస్థలకు పాలకులను ఎంపిక చేసినట్లు
తెలుస్తోంది.
- మొగలుల కాలంలో పట్టణ పాలనను కొత్వాల్ అనే అధికారి చూసుకునేవాడు.
కొత్వాల్కు సహాయంగా మున్సబ్ అనే అధికారి ఉండేవాడు.
బ్రిటీష్ కాలంలో....
- మద్రాసు నగరపాలక కార్పొరేషన్ స్థాపనతో భారతదేశంలో ఆధునిక స్థానిక
ప్రభుత్వ చరిత్ర ప్రారంభమైందని చెప్పవచ్చు. రెండో జేమ్స్ చక్రవర్తి
జారీచేసిన చార్టర్(1687 ) ద్వారా పన్నుల వసూలు కోసం మద్రాసు మున్సిపల్
కార్పొరేషన్ను ఈస్ట్ ఇండియా కంపెనీ స్థాపించింది.
- బ్రిటీషువారు జిల్లాను ఒక యూనిట్గా తీసుకొని 1772లో కలెక్టర్ అనే పదవిని
ప్రవేశపెట్టారు.
- చార్టర్ చట్టం(1813) ద్వారా స్థానిక సంస్థలకు పన్ను విధించడానికి, అవి
చెల్లించని వారిపై చర్యలు తీసుకునే అధికారాన్ని కల్పించారు.
- భారతదేశానికి గవర్నర్ జనరల్(1835-36)గా పనిచేసిన మెట్కాఫ్ భారతదేశ
గ్రామీణ సమాజాలను లిటిల్ రిపబ్లిక్స్గా అభివర్ణించారు. నేడు అవే స్థానిక
ప్రభుత్వాలుగా మార్పు చెందాయి.
- భారత కౌన్సిళ్ల చట్టం(1861) ద్వారా స్థానిక అవసరాలను తీర్చే బాధ్యతను
రాష్ర్టాలకు అప్పగించారు.
- ఆర్థిక వికేంద్రీకరణ తీర్మానం (1870) ద్వారా భారతదేశంలో మొదటిసారిగా
వైస్రాయ్ లార్డ్ మేయో స్థానిక ప్రభుత్వాలను ప్రవేశపెట్టాడు.
- వైస్రాయ్ లార్డ్ రిప్పన్ స్థానిక ప్రభుత్వాలను ఆర్థిక, పాలనాపరమైన
అధికారాలను బదలాయిస్తూ 18మే 1882లో ఒక తీర్మానాన్ని ప్రతిపాదించాడు. అతని
తీర్మానాన్ని భారతదేశంలో స్థానిక ప్రభుత్వాల ఏర్పాటు, వికాసాలకు
మాగ్నాకార్టాగా వర్ణించారు. అందుకే లార్డ్ రిప్పన్ స్థానిక సంస్థల
పితామహుడుగా ప్రఖ్యాతి పొందాడు.
1882లో స్థానిక ప్రభుత్వాల చట్టం ప్రకారం..
- రిప్పన్ తరువాత భారతదేశాన్ని పరిపాలించిన గవర్నరు జనరల్స్ స్థానిక
ప్రభుత్వాలకు క్రమేణా అధికారాలను విస్తృతం చేయడానికి అనేక చర్యలు
తీసుకున్నారు. వాటిలో ముఖ్యమైనవి...
బెంగాల్ మున్సిపాలిటీ చట్టం (1884)
బెంగాల్ స్థానిక ప్రభుత్వాల చట్టం (1885)
బెంగాల్ స్థానిక గ్రామీణ స్వయం పాలనా చట్టం (1919)
భారతదేశంలో స్థానిక ప్రభుత్వాల పనితీరును, అవి విజయవంతం కాకపోవడాన్ని
సమీక్షించడానికి 1907 సంవత్సరంలో సర్ చార్లెస్ హబ్ అధ్యక్షతన రాయల్
వికేంద్రీకరణ సంఘం నియమించబడింది. అది 1909లో సమర్పించిన నివేదిక కింది
అంశాలను పేర్కొంది. అవి..
- దేశంలో ప్రతి గ్రామానికి ఒక గ్రామ పంచాయతీ ఉండాలి.
- 3 స్థాయిల్లో గల స్థానిక ప్రభుత్వాల సభ్యుల్లో ఎక్కువ మంది ప్రజలను
ప్రత్యక్షంగా ఎన్నుకోవాలి.
- ప్రాథమిక విద్య బాధ్యత మున్సిపాలిటీలకు ఉండాలి.
- రాయల్ కమిషన్ సూచనల మేరకే మింటో మార్లే సంస్కరణలు (1909) చట్టంలో స్థానిక
సంస్థల ప్రతినిధులను ప్రజల చేత ప్రత్యక్షంగా ఎన్నుకొనే పద్ధతిని
ప్రవేశపెట్టారు.
- స్థానిక స్వయంపాలనను మాంటెగ్-ఛేమ్స్ఫర్డ్ సంస్కరణల(1919) ద్వారా రాష్ట్ర
జాబితాలో చేర్చారు. అందువల్ల ఆయా రాష్ట్ర శాసనసభలు ప్రతి రాష్ట్రంలోనూ
స్థానిక పరిపాలన కోరుతూ శాసనాలు చేశాయి. 1919 నాటికి జిల్లాల సంఖ్య 207,
తాలూకా బోర్డుల సంఖ్య 584కు చేరింది.
- భారత ప్రభుత్వ చట్టం (1935) ప్రకారం రాష్ర్టాలకు స్వపరిపాలనాధికారం
లభించడంతో స్థానిక స్వపరిపాలన మరింత పటిష్టమైంది. అధికారులు నామినెట్ చేసే
పద్ధతిని పూర్తిగా రద్దుచేశారు. స్థానిక ప్రభుత్వ పాలన పూర్తిగా మంత్రుల
చేతిలోకి వచ్చింది. ఈ చట్టం జిల్లా బోర్డుల్లో రాష్ర్టాలకు పూర్తి
స్వాతంత్య్రం కల్పించడం వల్ల స్థానిక సంస్థలకు ప్రజాస్వామ్య పద్ధతిలో
సంస్కరించడానికి ప్రయత్నాలు జరిగాయి.
అశోక్ మెహతా కమిటీ
బల్వంత్రాయ్ మెహతా కమిటీ సిఫారసుల ప్రకారం ఏర్పాటు చేసిన పంచాయతీ రాజ్
సంస్థలు అనుకున్న లక్ష్యాలను సాధించలేదు. దీంతో వాటి పనితీరును
సమీక్షించడానికి, పంచాయతీరాజ్ వ్యవస్థను సమగ్రంగా పరిశీలించడానికి డిసెంబర్
1977లో అప్పటి ప్రధానమంత్రి మొరార్జీ దేశాయ్ నేతృత్వంలోని జనతా ప్రభుత్వం
అశోక్ మెహతా అధ్యక్షతన ఒక కమిటీని నియమించింది. ఈ కమిటీ 132 సిఫారసులతో తన
నివేదికను 1978 ఆగస్టులో సమర్పించింది.
సిఫారసులు
మూడంచెల పంచాయతీరాజ్ వ్యవస్థ స్థానంలో రెండంచెల వ్యవస్థను ప్రవేశపెట్టాలి.
అది జిల్లా స్థాయిలో జిల్లా పరిషత్, బ్లాక్ స్థాయిలో మండల పంచాయతీ
ఏర్పాటుచేసి, గ్రామపంచాయతీలను రద్దుచేసి వాటిస్థాయిలో గ్రామ కమిటీలను
ఏర్పాటు చేశాలి.
-15వేల నుంచి 20వేల జనాభాతో కూడిన కొన్ని గ్రామాలను మండల పంచాయతీగా ఏర్పాటు
చేయాలి.
- అర్హుడైన న్యాయాధికారి అధ్యక్షతన న్యాయ పం చాయతీ సంస్థను ప్రత్యేక
వ్యవస్థగా ఏర్పాటు చేయాలి.
- పంచాయతీ రాజ్ సంస్థల వ్యవహారాల పర్యవేక్షణ కోసం పంచాయతీ రాజ్ మంత్రిని
నియమించాలి.
- పంచాయతీ రాజ్ వ్యవస్థ ఎన్నికల్లో రాజకీయ పార్టీలు ప్రత్యక్షంగా పోటీ
చేయాలని సూచించింది.
-షెడ్యూలు కులాలు, తెగల వారికి జ నాభా ప్రాతిపదికన రిజర్వేషన్లు
కల్పించాలి.
- జిల్లా స్థాయి సంస్థల్లో పంచాయతీ రాజ్ అకౌంట్స్ ఆడిట్ జరపాలి.
- పంచాయతీలను రాష్ట్ర ప్రభుత్వం రద్దు చేయరాదు. ఒకవేళ రద్దు చేస్తే 6
నెలల్లో ఎన్నికలను నిర్వహించాలి.
- జిల్లా పరిషత్ అధ్యక్షున్ని పరోక్షంగా ఎన్నుకోవాలి. అయితే మండల పరిషత్
అధ్యక్షున్ని పత్యక్షంగా కానీ, పరోక్షంగా గానీ ఎన్నుకోవచ్చు.
-పంచాయతీరాజ్ సంస్థలు ప్రభుత్వ నిధులపై ఆధారపడకుండా పన్నులు విధించి
స్వతంత్రంగా నిధులు సమకూర్చుకోవాలి.
- పంచాయతీరాజ్ సంస్థలో అన్ని పదవులకు కాల వ్యవధిని 4 ఏండ్లుగా
నిర్ణయించాలి.
జనతా ప్రభుత్వం రద్దు కావడంతో ఈ నివేదికను అమలు చేయలేదు. అయితే అశోక్ మెహతా
కమిటీ సిఫారసులను 1979లో జరిగిన రాష్ర్టాల ముఖ్యమంత్రుల సమావేశంలో
చర్చించి కొన్ని మార్పులతో ఆమోదించారు. ఆంధ్రప్రదేశ్, పశ్చిమబెంగాల్,
కర్ణాటక వంటి కొన్ని రాష్ర్టాలు అశోక్ మెహతా కమిటీ సిఫారసుల్లోని కొన్ని
అంశాలను తమ రాష్ర్టాలకు అనుగుణంగా మార్పు చేసుకొని అమలుచేశాయి.
నోట్ : బల్వంత్రాయ్ మెహతా కమిటీ సూచనల ద్వారా ఏర్పాటైన పంచాయతీ వ్యవస్థలను
మొదటితరం పంచాయతీలని అంటారు.
- ఆశోక్ మెహతా కమిటీ సిఫార్సులు ఆధారంగా ఏర్పాటైన(ఆంధ్రప్రదేశ్,
పశ్చిమబెంగాల్, కర్ణాటక)పంచాయతీ వ్యవస్థలను రెండోతరం పంచాయతీలని అంటారు.
బల్వంత్రాయ్ మెహతా కమిటీ - సిఫారసులు
సమాజాభివృద్ధి పథకం, జాతీయ విస్తరణ సేవా పథకాల ద్వారా ఆశించిన ఫలితాల
కలగకపోవడంతో గ్రామ స్వపరిపానలో ప్రజలకు భాగస్వామ్యం కల్పించడానికి అవసరమ్యే
సంస్థాగత ఏర్పాటును సూచించవలసిందిగా ప్రణాళికా సంఘంలోని ప్రణాళికా పథకాల
కమిటీ(జాతీయాభివృద్ధి మండలి) 16 జనవరి 1957లో బల్వంత్రాయ్ గోపాల్ మెహతా
అధ్యక్షతన ఒక కమిటీని ఏర్పాటు చేసింది. ఈ కమిటీ ప్రజస్వామ్య
వికేంద్రీకరణ-ప్రజల భాగస్వామ్యం అనే అంశాలతో మూడంచెల పంచయతీ రాజ్ వ్యవస్థను
సిఫార్సు చేస్తూ తన నివేదికను 24 నవంబర్ 1957లో సమర్పించింది.
బల్వంత్రాయ్ కమిటీ సిఫార్సులను జాతీయాభివృద్ధి మండలి1958 జనవరిలో
ఆమోదించింది. దీంతో వివిధ రాష్ర్టాలు పంచాయతీరాజ్ సంస్థల ఏర్పాటుకు తగిన
చట్టాలు చేశాయి.
-1959లో స్థానిక స్థానిక స్వపరిపాలనా సంస్థలను ఏర్పాటు చేసినప్పటికీ
ఎన్నికలు మాత్రం 1964లో నిర్వహించారు.
సిఫారసులు
-దేశంలో మూడంచెల పంచాయతీరాజ్ వ్యవస్థను ఏర్పాటు చేయాలి. జిల్లా స్థాయిలో
జిల్లా పరిషత్, గ్రామ స్థాయిలో గ్రామ పంచాయతీ, బ్లాక్ స్థాయిలో పంచాయతీ
సమితిని ఏర్పాటు చేశారు.
- స్థానిక సంస్థలకు ప్రతీ ఐదేళ్లకొకసారి ఎన్నికలు నిర్వహించాలి.
-ఎన్నికలు పార్టీ ప్రాతిపదికపై కాకుండా స్వతంత్రంగా జరగాలి.
- గ్రామ పంచాయతీ వ్యవస్థకు ప్రత్యక్ష ప్రాతిపదికపై ఎన్నికలు నిర్వహించాలి.
- జిల్లా పరిషత్, పంచాయతీ సమితుల అధ్యక్షులను పరోక్ష పద్ధతిలో ఎన్నుకోవాలి.
-స్థానిక అంశాలకు చెందిన అధికారాలను ఈ సంస్థలకు బదలాయించాలి.
- స్థానిక ప్రభుత్వాలకు చెందిన అభివృద్ధి కార్యక్రమాలను పంచాయతీరాజ్
సంస్థల ద్వారానే అమలు చేయాలి.
- పంచాయతీ సమితి కార్యనిర్వాహక అధికారాలను, జిల్లాపరిషత్కు సలహా
పర్యవేక్షణ అధికారాలను కల్పించాలి.
-గ్రామ పంచాయతీ వ్యవస్థకు ప్రత్యక్ష ఎన్నికలను నిర్వహించాలి.

FUNDAMENTAL DUTIES
Now-a-days, terms like ‘right to education’, ‘right to information’ and ‘right to protest peacefully’ are being used quite frequently. Many a time, you also feel that you have certain rights. Simultaneously, you may have been told by some one, may be your teacher, that you have certain duties towards other individuals, society, nation or the humanity. But do you think that every human being enjoys the rights or everyone performs the duties? Perhaps not. But everyone will agree that there are certain rights that must be enjoyed by individuals. Particularly, in a democratic country like ours, there are rights that must be guaranteed to every citizen. Similarly there are certain duties that must be performed by democratic citizens. Which is why, the Constitution of India guarantees some rights to its citizens. They are known as Fundamental Rights. Besides, the Indian Constitution also enlists certain core duties that every citizen is expected to perform. These are known as Fundamental Duties. This lesson aims atdiscussing the details about the Fundamental Rights and Fundamental Duties.
FUNDAMENTAL DUTIES
It shall be the duty of every citizens of India-
(a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;
(b) to cherish and follow the noble ideals which inspired our national struggle for freedom;
(c) to uphold and protect the sovereignty, unity and integrity of India;
(d) to defend the country and render national service when called upon to do so;
(e) to promote harmony and the spirit of common brotherhood amongst all the people of India transcending religious, linguistic and regional or sectional diversities; to renounce practices derogatory to the dignity of women;
(f) to value and preserve the rich heritage of our composite culture;
(g) to protect and improve the natural environment including forests, lakes, rivers and wild life, and to have compassion for living creatures;
(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;
(i) to safeguard public property and to abjure violence;
(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.]
3rd National Panchayati Raj Day
The Ministry of Panchayati Raj will be holding a day long National conference on the occasion of the 3rdNational Panchayati Raj Day at VigyanBhawan, New Delhi, on April 24. On the occasion, best performing Gram Panchayats would be conferred with” Rashtriya Gaurav Gram Sabha Purskar, 2012, while another 170 Panchayati Raj Institutions (PRIs) comprising of three –tier Panchayats would be facilitated with Panchayat Sashaktikaran Puraskar for their exemplary work under the Panchayat Empowerment Accountability Incentive Scheme (PEAIS ).
During the conference, the five different groups of delegates would be discussing the topics such as (i) Gram Sabha and People’s Participation, (ii) Devolution of 3Fs i.e Funds, Functions and Functionaries (iii) Issues related to Women (iv) Agriculture, Rural Development and Livelihood and (v) Management of Forest Produce/Natural Resources.
Approximately 1500 delegates such as State Ministers for Panchayati Raj, Senior officials from State Government Panchayati Raj Departments, States elected representatives (ERs) from the three tiers of PRIs, the national award winning Panchayats as well as representatives from SCs/STs and Women would attend the National Conference.
The Constitution (73rd Amendment) Act, 1992 that came into force with effect from 24th April, 1993 has institutionalized Panchayati Raj through the Village, Intermediate and District levels Panchayats. This date thus marks a defining moment in the history of decentralization of political power to the grassroots level. The impact of the 73rd Amendment in rural India is very visible as it has changed power equations irreversibly. Accordingly, the Government of India decided in consultation with the States to celebrate 24th April as National Panchayati Raj Day. Ministry of Panchayati Raj organises National Conference on 24th April every year to commemorate the National Panchayati Raj Diwas.

పాలిటీ - భారత రాజ్యాంగం
భారతదేశం రాష్ట్రాల కలయిక అంటే యూనియన్. ఏడో షెడ్యూల్ ప్రకారం కేంద్ర- రాష్ట్రాల మధ్య పాలనకు సంబంధించిన అధికారాలు విభజించారు. సమాఖ్య విధానాన్ని అనుసరించినప్పటికీ, రాజ్యాంగంలో సమాఖ్యకు బదులుగా యూనియన్ అనే పదాన్ని ఉపయోగించారు. బి.ఆర్. అంబేద్కర్ సూచన ప్రకారం కెనడా దేశ సమాఖ్యను ఆధారంగా తీసు కున్నారు. మన రాజ్యాంగంలో కూడా యూనియన్ అనే పదాన్ని వినియోగించారు. దీనికి ప్రధాన కారణం మన సమాఖ్య సూత్రబద్దం కాకపోవడమే. ‘సమాఖ్య’ పదానికి సమాన ఆంగ్ల పదం ‘ఫెడరేషన్.’ ఇది లాటిన్లోని ‘ఫోడస్’ అనే పదం నుంచి ఉద్భవించింది. ఫోడస్ అంటే ‘ఒప్పందం’ అని అర్థం. ఈవిధంగా ఏర్పడిన ప్రభుత్వానికి ఉత్తమ ఉదాహరణ అమెరికా సమాఖ్య. 1776లో అమెరికా స్వాతంత్య్రం పొందిన తర్వాత 1787లో రాజ్యాంగాన్ని రూపొందించుకునే నాటికి అమెరికాలోని 13 రాష్ట్రాల మధ్య కుదిరిన ఒప్పంద అవగాహనే అమెరికా సంయుక్త రాష్ట్రాలు. మనది అమెరికా వంటి సమాఖ్య కాదు.
ఒప్పంద ఫలితం కూడా కాదు. పాలనా సౌలభ్యం కోసం మాత్రమే రాజ్యాంగం ద్వారా కేంద్ర, రాష్ట్రాల మధ్య అధికారాలు పంపిణీ చేశారు. అందువల్ల ఏ విభాగానికి, రాష్ట్రానికి లేదా కేంద్రపాలిత ప్రాంతానికి మన దేశం నుంచి విడిపోయే అధికారం లేదు. పాలనా సౌలభ్యం కోసం మాత్రమే రాష్ట్రాల పునర్విభజన చేశారు.
రాష్ట్రాల విభజన:
రాష్ట్రాల పునర్విభజన సమయంలో కూడా పూర్తి అధికారం కేంద్ర ప్రభుత్వం అంటే పార్లమెంట్కు మాత్రమే ఉంది. రాష్ట్రాల పునర్ వ్యవస్థీకరణ సమయంలో రాష్ర్టపతి ఆ రాష్ర్ట శాసనసభ అభిప్రాయం తెలుసుకోవచ్చు. ఐతే శాసనసభ అభిప్రాయాన్ని కచ్చితంగా పాటించాల్సిన అవసరం కేంద్రానికి లేదు. కేంద్రం తన ఇష్టానుసారం నిర్ణయం తీసుకుంటుంది. రాజ్యాంగంలోని రెండో అధికరణ ప్రకారం దేశ భూభాగంపై ఎలాంటి నిర్ణయమైనా తీసుకొనే అధికారం పార్లమెంట్కు ఉంది.
1960లో బేరూబారి కేసులో మన భూభాగాన్ని ఇతరులకు బదిలీ చేసే సందర్భంలో, ఇతర భూభాగాలు మన దేశంలో విలీనం చేసే సందర్భంలోనూ రాజ్యాంగ సవరణల ద్వారా పార్లమెంట్ నిర్ణయం తీసుకోవాలనీ.. అంతర్గత భూ భాగంలో మార్పులు చేసే సందర్భంలో రాజ్యాంగ సవరణలు తప్పనిసరి కావని సుప్రీంకోర్టు తీర్పు ఇచ్చింది. ఈ తీర్పు ప్రకారం దేశంలోని భూభాగం విషయంలో, రాష్ట్రాల పునర్విభజన సమయంలోనూ నిర్ణయాధికారం కేంద్ర ప్రభుత్వానికే ఉంది.
రాజ్యాంగ నిర్మాతలు దేశ పరిస్థితులకు అనుగుణంగా సమాఖ్య వ్యవస్థను నిర్మించారు. ‘ఏ దేశం రాజ్యాంగమైనా నాటి పరిస్థితులను ప్రతిబింబిస్తుందని’ నెహ్రూ పేర్కొనడానికి ఎంతో ప్రాముఖ్యం ఉంది.
భారతదేశం స్వాతంత్య్రం పొందిన తర్వాత సొంత రాజ్యాంగాన్ని రూపొందించుకొనే సందర్భంలో దేశ విభజన కాలం నాటి పరిస్థితులు, శాంతి భద్రతల పరిరక్షణ, స్వదేశీ సంస్థానాలను విలీనం చేయడం.. వంటి అంశాలను దృష్టిలో ఉంచుకొని, కేంద్రంలో బలమైన ప్రభుత్వాన్ని ఏర్పాటుచేసే ఉద్దేశంతో ఏకకేంద్ర లక్షణాలను పొందుపర్చారు. భారతదేశ భిన్నత్వం, దేశ విశాల పాలనా పరిధి ఆధారంగా ఆంగ్లేయులు 1935 చట్టం ద్వారా ఫెడరల్ వ్యవస్థను పరిగణలోనికి తీసుకొని సమాఖ్య లక్షణాలు కూడా పొందుపర్చారు. దీంతో మన సమాఖ్య అర్ధ సమాఖ్యగా రూపొందిందని కె.సి.వేర్ పేర్కొన్నారు. అంబేద్కర్ ప్రకారం ‘దేశం సాధారణ పరిస్థితుల్లో సమాఖ్య వ్యవస్థగా, అత్యవసర పరిస్థితుల్లో ఏక కేంద్ర ప్రభుత్వంగా పని చేస్తుంది.’ అంటే దేశం ఏక కేంద్ర, సమాఖ్య లక్షణాల కలయికగా ఏర్పడింది.’
అధికారాల పంపిణీ:
రాజ్యాంగంలోని ఏడో షెడ్యూల్లో కేంద్ర -రాష్ర్ట ప్రభుత్వాల మధ్య అధికారాల పంపిణీకి సంబంధించిన జాబితా ఉంది.
కేంద్ర జాబితా: జాతీయ, అంతర్జాతీయ ప్రాముఖ్యం ఉన్న 97 అంశాలు కేంద్ర జాబితాలో పొందుపర్చారు. కొన్ని మార్పుల కారణంగా ప్రస్తుతం ఈ జాబితాలోని అంశాల సంఖ్య 100కు చేరింది. 92వ అధికరణలో అంత రాష్ర్ట వ్యాపార, వాణిజ్యానికి సంబంధించిన పన్ను; కన్సైన్మెంట్ టాక్స్తో పాటు సేవలపై పన్ను అనే అంశాలను చేర్చడంతో ప్రస్తుతం ఈ జాబితాలో 100 అంశాలు ఉన్నాయి.
రాష్ట్ర జాబితా: ప్రాంతీయ ప్రాముఖ్యం ఉన్న 66 అంశాలను రాష్ర్ట జాబితాలో పొందుపర్చారు. 1976లో 42వ రాజ్యాంగ సవరణ ద్వారా ఐదు అంశాలను రాష్ర్ట జాబితా నుంచి తొలగించి ఉమ్మడి జాబితాలో చేర్చారు. ప్రస్తుతం ఈ జాబితాలో 61 అంశాలు మాత్రమే ఉన్నాయి.
ఉమ్మడి జాబితా: ప్రాంతీయ ప్రాముఖ్యం ఉన్నప్పటికీ జాతీయ దృక్కోణం కూడా అవసరమైన 47 అంశాలను ప్రారంభంలో ఉమ్మడి జాబితాలో చేర్చారు.
ఐతే 1976లో రాష్ర్ట జాబితాకు చెందిన ఐదు అంశాలు ఉమ్మడి జాబితాకు బదిలీ చేశారు. దీంతో ఈ జాబితాలోని అంశాల సంఖ్య 52కు చేరింది. ఉమ్మడి జాబితా అనే భావనను ఆస్ట్రేలియా నుంచి గ్రహించారు. పైన పేర్కొన్న మూడు జాబితాల్లో చేరని అంశాలు, కొత్తగా వచ్చే అంశాలను అవశిష్ట అధికారాలు అంటారు. ఈ అధికారాలను కేంద్రానికి కేటాయించారు. ఈ విషయంలో కెనడాను అనుసరించారు. కేంద్ర, రాష్ర్ట ప్రభుత్వాల మధ్య అధికారాల పంపిణీ వల్ల కేంద్ర ప్రభుత్వ పరిధిని గురించి 73వ అధికరణ, రాష్ర్ట ప్రభుత్వ అధికార పరిధిని 162వ అధికరణలో పేర్కొన్నారు. అధికారాల పంపిణీ, పరిధిని రాజ్యాంగం ద్వారానే నిర్ణయించడం వల్ల మన రాజ్యాంగం లిఖిత పూర్వకమైంది.
రాజ్యంగ సవరణలు:
సమాఖ్య వ్యవస్థలో రాజ్యాంగం ద్రుఢంగా ఉంటుంది. కారణం అధికారాల పంపిణీ రాజ్యాంగం ద్వారా జరగడం వల్ల రాజ్యాంగంలో ఎలాంటి సవరణలు చేయాలన్నా కూడా భారత పార్లమెంట్ 2/3వ వంతు మెజారిటీతో ఆమోదించి, 1/2వ వంతు రాష్ట్రాలు ఆ బిల్లును ఆమోదించాలి. రాజ్యాంగంలోని సమాఖ్య లక్షణాల్లో ఏ మార్పు చేయాలన్నా ఈ పద్ధతినే ఉపయోగించాలి. రాజ్యాంగ సవరణలో రాష్ట్రాల ఆమోదం పొందే పద్ధతిని అమెరికా నుంచి గ్రహించారు.
రాజ్యాంగ పరిధికి లోబడే:
కేంద్ర-రాష్ర్ట ప్రభుత్వాలు, రాష్ట్రాలు-రాష్ట్రాల మధ్య తలత్తే వివాదాలను పరిష్కరించడంలో సుప్రీంకోర్టు కీలక పాత్ర పోషిస్తుంది. సుప్రీంకోర్టుకు స్వయంప్రతిపత్తి కల్పించారు. దేశంలో కేంద్ర-రాష్ర్ట ప్రభుత్వాలు రాజ్యాంగ పరిధిలోనే ఏర్పడి, రాజ్యాంగం ద్వారానే అధికారాలు పొంది, రాజ్యాంగ పరిధికి లోబడి తమ అధికారాలు నిర్వర్తిస్తాయి. ప్రభుత్వాల మధ్య తలెత్తే సమస్యలను రాజ్యాంగ పరిధికి లోబడే సుప్రీంకోర్టు పరిష్కరిస్తోంది. దాంతో మన దేశంలో రాజ్యాంగ ఆధిక్యత ఉన్నట్టు పేర్కొనొచ్చు.
జాతీయ, అంతర్జాతీయ ప్రాముఖ్యం ఉన్న అంశాలు కేంద్ర ప్రభుత్వం; ప్రాంతీయ ప్రాముఖ్యం ఉన్న అంశాలు రాష్ర్ట ప్రభుత్వాలు నిర్వర్తిస్తాయి. ఈ విధంగా రెండు స్థాయిల్లో ప్రభుత్వాలు పని చేస్తున్నాయి. సమాఖ్య విధానాన్ని అనుసరించే దేశాల్లో ఎగువ సభలు రాష్ట్రాలకు ప్రాతినిధ్యం వహిస్తున్నాయి. మన దేశంలో దిగువ సభ లోక్సభ ప్రజలకు, ఎగువసభ రాజ్యసభ రాష్ట్రాలకు ప్రాతినిధ్యం వహిస్తున్నాయి. భారతదేశం కూడా అన్ని సమాఖ్యల మాదిరిగానే మౌలిక లక్షణాలను కలిగి ఉంది. దేశ ప్రత్యేక పరిస్థితులను దృష్టిలో ఉంచుకొని మన సమాఖ్య విధానం రూపొందింది.
అమెరికా సమాఖ్యతో పోల్చితే..
ప్రపంచంలో వాస్తవ సమాఖ్యకు ఉదాహరణగా, ఆదర్శ సమాఖ్య దేశంగా అమెరికాను పేర్కొంటారు. ఎన్నో అంశాల్లో అమెరికాతో మన సమాఖ్య విభేదిస్తోంది. అమెరికా పౌరులకు ద్వంద్వ పౌరసత్వ ఉంది. భారతదేశంలో ఒకే పౌరసత్వ ఉంది. పౌరసత్వంలో మనం బ్రిటన్ను అనుసరించాం. అమెరికాలో అవశిష్ట అధికారాలను రాష్ట్రాలకు కేటాయిస్తే, మన దేశంలో అవశిష్ట అధికారాలను కేంద్ర ప్రభుత్వానికి కట్టబెట్టారు. ఈ విషయంలో కెనడాను అనుసరించాం.
అమెరికాలో కేంద్ర, రాష్ర్ట ప్రభుత్వాలకు వేర్వేరుగా రెండు రాజ్యాంగాలు ఉంటాయి. మన దేశంలో ఒకే రాజ్యాంగం ఉంది. న్యాయ వ్యవస్థ విషయంలో అమెరికాలో వికేంద్రీకరణ ఉంది. అక్కడ జాతీయ, రాష్ట్రాల న్యాయ వ్యవస్థలు వేర్వేరుగా ఉంటాయి. మన దేశంలో ఏకీకృత న్యాయ వ్యవస్థ ఏర్పాటు చేశారు. బ్రిటిష్ ప్రభుత్వ కాలంలో ప్రవేశపెట్టిన సమీకృత న్యాయవ్యవస్థనే మనం అనుసరిస్తున్నాం.
రాష్ట్రాలకు ప్రాతినిధ్యం వహించే ఎగువ సభల విషయం కూడా భారత్, అమెరికాల మధ్య భిన్నత్వం ఉంటుంది. అమెరికా సెనేట్లో మొత్తం 100 మంది సభ్యులుంటారు. వారంతా 50 రాష్ట్రాల నుంచి.. ఒక్కొక్క రాష్ర్టం నుంచి ఇద్దరు సభ్యుల చొప్పున ప్రాతినిధ్యం వహిస్తున్నారు. మన రాజ్యసభలో రాష్ట్రాలకు అసమాన ప్రాతినిధ్యం ఉంది.
ఉత్తరప్రదేశ్కు రాజ్యసభలో 31 స్థానాలు ఉంటే.. అస్సాంను మినహాయించి మిగిలిన ఏడు ఈశాన్య రాష్ట్రాలు, గోవా నుంచి ఒక్కో సభ్యునికే ప్రాతినిధ్యం ఉంది. వాస్తవిక సమాఖ్యలో చిన్న, పెద్ద రాష్ట్రాలకు ఒకే విధమైన ప్రాతినిధ్యం ఉంటుంది. మన దేశంలో దీని భిన్నంగా ఉంది. రాజ్యాంగ సవరణ విషయంలో కూడా భిన్నత్వం ఉంది. భారత రాజ్యాంగం ద్రుఢ, అద్రుఢ లక్షణాల కలయికతో రూపొందించినప్పటికీ, అద్రుఢ లక్షణాలే ఎక్కువగా ఉన్నాయి.
రాజ్యాంగంలోని అనేక అంశాలను సాధారణ మెజార్టీతోనే పార్లమెంటు సవరిస్తుంది. రాజ్యాంగ సవరణ విషయంలో రాష్ట్రాల చొరవకు అవకాశం లేదు. పార్లమెంటు చేసే రాజ్యాంగ సవరణల్లో మార్పులు చేసే అధికారం రాష్ట్రాలకు లేదు. అందువల్ల మన దేశాన్ని ‘బలమైన కేంద్రీకృత ధోరణుల సమాఖ్య వ్యవస్థగా’ సర్ ఐవర్ జెన్నింగ్స వర్ణించారు. అలెగ్జాండ్రో విజ్ మన దేశాన్ని ‘వాస్తవిక సమాఖ్యగానే’ పేర్కొన్నారు.

Aristotle's theory of slavery
Slavery -- natural or conventional?
Aristole's theory of slavery is found in Book I, Chapters iii through vii of the Politics. and in Book VII of the Nicomachean Ethics Aristotle raises the question of whether slavery is natural or conventional. He asserts that the former is the case. So, Aristotle's theory of slavery holds that some people are naturally slaves and others are naturally masters. Thus he says: But is there any one thus intended by nature to be a slave, and for whom such a condition is expedient and right, or rather is not all slavery a violation of nature? There is no difficulty in answering this question, on grounds both of reason and of fact. For that some should rule and others be ruled is a thing not only necessary, but expedient; from the hour of their birth, some are marked out for subjection, others for rule. This suggests that anyone who is ruled must be a slave, which does not seem at all right. Still, given that this is so he must state what characteristics a natural slave must have -- so that he or she can be recognized as such a being. Who is marked out for subjugation, and who for rule? This is where the concept of "barbarian" shows up in Aristotle's account. Aristotle says: But among barbarians no distinction is made between women and slaves, because there is no natural ruler among them: they are a community of slaves, male and female. Wherefore the poets say, It is meet that Hellenes should rule over barbarians; as if they thought that the barbarian and the slave were by nature one. So men rule naturally over women, and Greeks over barbarians! But what is it which makes a barbarian a slave? Here is what Aristotle says: Where then there is such a difference as that between soul and body, or between men and animals (as in the case of those whose business is to use their body, and who can do nothing better), the lower sort are by nature slaves, and it is better for them as for all inferiors that they should be under the rule of a master. For he who can be, and therefore is, another's and he who participates in rational principle enough to apprehend, but not to have, such a principle, is a slave by nature. Whereas the lower animals cannot even apprehend a principle; they obey their instincts. And indeed the use made of slaves and of tame animals is not very different; for both with their bodies minister to the needs of life. Nature would like to distinguish between the bodies of freemen and slaves, making the one strong for servile labor, the other upright, and although useless for such services, useful for political life in the arts both of war and peace. But the opposite often happens--that some have the souls and others have the bodies of freemen. And doubtless if men differed from one another in the mere forms of their bodies as much as the statues of the Gods do from men, all would acknowledge that the inferior class should be slaves of the superior. And if this is true of the body, how much more just that a similar distinction should exist in the soul? but the beauty of the body is seen, whereas the beauty of the soul is not seen. It is clear, then, that some men are by nature free, and others slaves, and that for these latter slavery is both expedient and right. So the theory is that natural slaves should have powerful bodies but be unable to rule themselves. Thus, they become very much like beasts of burden, except that unlike these beasts human slaves recognize that they need to be ruled. The trouble with this theory, as Aristotle quite explicitly states, is that the right kind of souls and bodies do not always go together! So, one could have the soul of a slave and the body of a freeman, and vice versa! Nonetheless, apparently because there are some in whom the body and soul are appropriate to natural slavery, that is a strong body and a weak soul, Aristotle holds that there are people who should naturally be slaves. It also seems that men naturally rule women and that bararians are naturally more servile than Greeks! This seems like an odd, indeed arbitrary, way for the virtues of the soul to be distributed! Las Casas deals with a similar problem in regard to the native peoples of the Americas. War and Slavery One interesting feature of Aristotle's discussion which does not clearly come out in the great debate has to do with slavery and war. Aristotle, early in the Politics says: But that those who take the opposite view [that is, who hold the view that slavery is not natural] have in a certain way right on their side, may be easily seen. For the words slavery and slave are used in two senses. There is a slave or slavery by law as well as by nature. The law of which I speak is a sort of convention-- the law by which whatever is taken in war is supposed to belong to the victors. But this right many jurists impeach, as they would an orator who brought forward an unconstitutional measure: they detest the notion that, because one man has the power of doing violence and is superior in brute strength, another shall be his slave and subject. So, those who hold that slavery is both conventional and legitimate hold the doctrine that all prisoners of war can be legitimately enslaved. If you lose the battle and are captured, that is enough. Aristotle gives reasons for rejecting this view. One is that this means that might makes right. Many people find this doctrine really objectionable. (Plato in The Republic and other dialogues is one of these.) The doctrine that might makes right means that if you have the power, and so win the battle, however unjust your cause, the spoils are legitimately yours. In fact, contrary to most of our intuitions, this view says that wining makes your cause just! Saint Augustine held a view like this conventional view, but he had an answer to Aristotle's objection. Since God decided who would win the battle, victory in battle amounts to a divine decision! To be captured in battle and enslaved is a divine punishment for sin! This connection between war and slavery is of some interest in the study of the period of the conquest of the Americas. For at this time Europeans were beginning to develop what has come to be know as just war theory. This theory holds that their are criteria for determining whether a war is just. So, you can lose but we can still recognize that your cause is just. Or you can win and we can still recognize that your cause is unjust. Courtney Campbell's essay "Dirt, Greed and Blood: Just War and the Colonization of the New World" explores the beginnings of this tradition in the Spanish writer Francisco de Vitoria. A later and important contributor to just war theory during the period we are studying was the Dutch Jurist Hugo Grotius. This discussion of war and slavery in Aristotle will turn out to be quite interesting when we come to explore John Locke's theory of slavery in The Second Treatise of Civil Government Locke does not believe in natural slaves or in the conventional view that all prisoners of war can be legitimately enslaved. He is a just war theorist who explicitly rejects the doctrine that might makes right.
